Arrest And Bail

What is arrest?
Arrest consists of a seizure or touching of a person's body for the purpose of holding or detaining him to answer a criminal charge or preventing the commission of a criminal offence.

When can an arrest take place?
An arrest may be made by a police officer or other persons empowered by law to do so. The police officer effecting the arrest can only do so upon reasonable suspicion of an offence having been committed by the person.

All necessary means may be employed to effect an arrest if a person resists attempts to arrest him. Resisting or obstructing the lawful arrest of a person is an offence.

    when arrested at school, why is it not made clear that you have in fact eben arrested.

    Here is a problem. If you don't know when you are arrested, the police likely aren't doing their job right. In fact, with an attorney's help you may be able to get the charges dropped if the police didn't follow the correct procedure when arresting you.

    Now a day’s corruption and unlawful activities are arising day by day in a huge volume. People are just getting affected of legal pressure. So people need more legal support for the preparation of legal documents which will help the victim to regain the state of authority.

    Now here's an infringement on rights. A person is charged with a crime, appointed an attorney who in the state of Maine is not a Public Defender, but a private attorney doing probono work. This attorney upon reading discovery of this person realized that his firm is representing the co-defendant so naturally he needs to let his new client go due to conflicts of interest. And, oh yes, bigtime, conflict of interest. This firm now has this person's discovery which can now be used to help their client, which is the co- defendant, what type of fair trial does this person get? None! Since this has happened, this person is just sitting in jail, no attorney, no court date and no idea what to do next. Can anyone advise me? I feel that this discovery should be inadmissable in court and the charges dropped and this person freed. At least, since he cannot afford an attorney, appoint him one. Is it not your right to have one appointed?
